Comments:
This application is a request for approval of a 1st Amendment to an existing Development Agreement for approximately 2.223 acres located at approximately 13660 S 300 E. The property is currently zoned RM1 (Multi-Family Residential, Up to 8 Units Per Acre) Zone. The applicant is requesting that a 1st Amendment to the existing Development Agreement be approved to move the location of the pedestrian access easement from between Lots 107 and 108 to a location between Lots 106 and 107 and widen the access easement from 5 feet to 8 feet.
The Brooks Lane Subdivision is a 10-lot minor subdivision with a private lane that was approved by the Zoning Administrator in May 2019. A Development Agreement was approved between the developer and the City in November 2017. A Land Use Designation Amendment and Zoning Map Amendment for the subdivision were approved at the same time with the Development Agreement. The Development Agreement restricted the development of the property to detached single-family homes and established the development standards.
One of the “Project-Specific Development Standards” included in the Development Agreement was a 5 foot wide pedestrian access between Lots 107 and 108 to provide access to the open space on the west side of the neighborhood. As the development has been moving forward with initial work, utilities were put in place which included large utility boxes within this designated pedestrian access, thereby limiting/inhibiting pedestrian access.
